Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Templit (the “Service”), a website and application operated by Nathan Hart, a sole proprietor based in the State of Georgia, United States (“Templit,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

You may not use the Service if you are prohibited from receiving services under the laws of the United States or any other applicable jurisdiction.

2. Your account

To use most features of the Service you must create an account. You agree to provide accurate and complete information when registering, to keep that information up to date, and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us promptly at nhart11474@gmail.com if you suspect unauthorized use.

We may suspend or terminate your account if you violate these Terms, if your use of the Service creates risk or legal exposure for us, or if we discontinue the Service.

3. Subscriptions, credits, and billing

The Service is offered through paid subscription plans. Pricing, plan tiers, and monthly credit allowances are described on our pricing page. Payments are processed by Stripe, Inc. (“Stripe”). By subscribing, you authorize us and Stripe to charge your payment method on a recurring basis according to the plan you select.

Subscriptions renew automatically at the end of each billing cycle until cancelled. You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.

Credits included with your plan reset at the start of each billing cycle and do not roll over to the next cycle. Unused credits have no cash value and are non-transferable.

Credits are deducted when a generation request is submitted to an AI provider. If you cancel a generation while it is running, the credits will not be refunded. If a generation fails, we may refund the credits at our discretion.

Fees are non-refundable. Except where required by applicable law, we do not provide cash refunds for unused credits or for accounts closed before the end of a billing cycle. If you change plans mid-cycle, any unused time on your previous plan is automatically applied as a prorated credit toward your next invoice; this credit has no cash value and is non-transferable. If you believe you have been billed in error, contact us within 30 days of the charge.

We may change our pricing, plan features, or credit allowances at any time. If we make a change that affects your active subscription, we will notify you by email before the change takes effect, and the change will apply starting with your next billing cycle.

4. AI-generated content

The Service uses third-party AI providers to generate voiceovers, images, video clips, and text based on inputs you provide. Outputs produced in response to your prompts and templates are referred to as “Generated Output.”

As between you and Templit, and subject to these Terms and the policies of the underlying AI providers, you own the Generated Output you create through the Service and may use it for personal or commercial purposes, including publishing it to TikTok, Instagram, YouTube, or other platforms.

You acknowledge that:

  • AI outputs are generated probabilistically and may be inaccurate, offensive, or infringe third-party rights. We do not warrant that Generated Output is unique, fit for any purpose, or free of intellectual property claims.
  • Similar or identical outputs may be produced for other users using similar inputs.
  • You are solely responsible for reviewing Generated Output before publishing or distributing it, and for ensuring its use complies with the terms of any platform where you publish it and with applicable law.
  • Your use of the Service is also subject to the acceptable-use policies of our upstream AI providers. See Section 9.

5. Your content and license to us

“User Content” means anything you upload, input, generate, or publish through the Service, including prompts, templates, uploaded media, scripts, voiceovers, images, video clips, and marketplace listings. You retain all rights you have in your User Content.

You grant Templit a worldwide, non-exclusive, royalty-free license to host, store, copy, transmit, process, display, and modify your User Content solely as necessary to operate and provide the Service to you (for example, rendering previews, storing templates, delivering exports, and transmitting inputs to AI providers to generate outputs on your behalf).

If you publish a template to the Templit marketplace, you additionally grant Templit and other Service users a worldwide, non-exclusive, royalty-free license to view, copy, import, modify, and use that template within the Service. You may remove your published templates from the marketplace at any time; copies already imported by other users may remain in their accounts.

You represent and warrant that you own or have all necessary rights to your User Content and that your User Content and its use by us and other users as permitted by these Terms will not violate any law or infringe any third-party right.

6. Acceptable use

You agree not to use the Service to create, upload, generate, or distribute content that:

  • is unlawful, fraudulent, defamatory, threatening, or harassing;
  • sexually exploits or endangers minors, or constitutes child sexual abuse material;
  • depicts non-consensual sexual content or real-person sexual content without consent;
  • promotes violence, self-harm, or illegal activity;
  • impersonates another person or entity, including by generating voice or likeness of an identifiable individual without their consent;
  • infringes the intellectual property, privacy, or publicity rights of any third party;
  • contains malware, viruses, or is otherwise designed to disrupt or damage any system; or
  • is intended to deceive or mislead audiences about matters of public importance (for example, political or health misinformation), or otherwise violates the content policies of any platform where you publish it.

You also agree not to:

  • reverse engineer, decompile, or otherwise attempt to extract the source code or underlying models of the Service, except as expressly permitted by law;
  • use the Service to train, fine-tune, or benchmark any competing AI model or product;
  • use automated means to access the Service at a volume that interferes with other users, or to circumvent credit limits or rate limits;
  • resell, sublicense, or redistribute access to the Service to third parties outside of the marketplace feature; or
  • use the Service in violation of any applicable export-control, sanctions, or similar law.

We may remove content, suspend accounts, or terminate access for violations of this section, with or without notice.

7. Intellectual property in the Service

The Service itself, including its software, design, user interface, branding, and the “Templit” name and logo, is owned by Nathan Hart and is protected by copyright, trademark, and other intellectual-property laws. Nothing in these Terms grants you any right in the Service other than the limited right to use it in accordance with these Terms.

8. Feedback

If you send us suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free, worldwide license to use that feedback for any purpose, without obligation to you.

9. Third-party services

The Service relies on third-party providers to authenticate users, process payments, host data, and generate AI outputs, including Supabase, Stripe, Google (for OAuth sign-in), OpenRouter, fal.ai, and Modal. Your use of the Service is subject to the terms and policies of those providers where applicable. We are not responsible for the acts or omissions of third-party providers. Additional detail on how we share data with them is in our Privacy Policy.

10. Service availability and changes

We provide the Service on an “as is” and “as available” basis and do not promise any specific level of uptime or performance. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuance.

11. Termination

You may stop using the Service and delete your account at any time from your settings. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if we are required to do so by law, or if we discontinue the Service.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnity, and governing law) will survive.

12. Disclaimers

Read this section carefully — it limits our liability to you.

THE SERVICE AND ALL GENERATED OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT GENERATED OUTPUT WILL BE ACCURATE, APPROPRIATE, OR SUITABLE FOR ANY PURPOSE. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING AND USING GENERATED OUTPUT.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER TEMPLIT NOR NATHAN HART WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Nathan Hart and Templit from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your User Content; (b) your use of the Service, including your use or distribution of Generated Output; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

15. Governing law and venue

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws principles. You and Templit agree that any dispute arising out of or related to these Terms or the Service that is not subject to an informal resolution will be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction of those courts.

16. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we will notify you by updating the “Last updated” date at the top of this page and, where appropriate, by email or in-product notice. Your continued use of the Service after the updated Terms take effect constitutes your acceptance of the changes.

17. Miscellaneous

These Terms are the entire agreement between you and Templit regarding the Service and supersede any prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign these Terms without our written consent; we may assign them freely. These Terms do not create any agency, partnership, or employment relationship between us.
